Patenting of higher life forms and related issues : report to the Government of Canada

abstract: This report identifies and examines issues relating to whether higher life forms should
be patentable in Canada. It concludes that plants and animals should be patentable,
provided that the special nature of biological inventions is taken into account. The
recommendations derive from research conducted by the Canadian Biotechnology Advisory
Committee and its consultations with key stakeholder groups and members of the public.
They reflect the importance of addressing social and ethical concerns related to
biotechnology and the balance between the rights of patent holders and those seeking
access to the benefits of biotechnological inventions.
